PERAN NOTARIS PADA PEMBUATAN AKTA PERJANJIAN PADA KARYA CIPTA LAGU "MABUR MINGGAT" (Studi di Kantor Notaris Herny Wahdaniyah Wahab, S.H., M.Kn)

The purpose of this study is to determine what are the contents of the deed of cooperation agreement and distribution made notary on the song Mabur Minggat and to determine the role of notaries in the making of the deed of agreement on the copyrighted work of the song Mabur Minggat. In this study using empirical research methods. Primary data obtained directly by the author at the Office of Notary Herny Wahdaniyah Wahab, S.H., M.Kn through interviews. The results of this study explain that in making a deed of agreement the role of notaries is very important because notaries are public officials who are authorized to make authentic deeds. Agreement is an agreement between the two parties between the Creator and the Arranger to perform an action. Agreements are very important to use in certain legal actions. Before making a notarial deed of agreement, the notary must pay attention to the legal requirements of the agreement, whether the parties have fulfilled the legal requirements of the agreement or not. In the contents of the agreement the parties make in accordance with the principle of freedom of contract, where the Parties themselves determine the contents of the agreement made. Therefore, the need for the role of a Notary in helping to create certainty and legal protection for the community and making a Deed of Agreement or Authentic Deed so that the Parties can achieve their respective goals and fully bind themselves and obey a statutory regulation. If one day there is a dispute, the deed of agreement can be used as valid / absolute evidence and has perfect legal force (volledig bewijs).Notary in making a deed of agreement needs to pay attention to things that are prohibited in making an authentic deed of agreement, therefore the notary must be honest, careful, thorough, and impartial to one of the parties and understand all the regulations relating to the deed he made.
