ANALISIS PENOLAKAN GANTI RUGI ATAS PENGADAAN TANAH JALUR KERETA API DI KABUPATEN MAROS SULAWESI SELATAN

This article aims to determine the implementation of compensation and the efforts of communities who refuse compenstion for the acquisition of railway land. In this study using empirical research methods. Primary data were obtained from informants of village heads and community representatives who also rejected the amount of compensation for land acquisition through interviews. And the legal materials used are legislation and journals. The results of this study show that the implementatjon of compensatjon for land acqujsition for the public interes of railway construction in Marusu District, Maros Regency has not been optimal. There is a conflict between the government and landowners due to the rejection of the compensation value and has not been optimal in conducting deliberations to determine the amount of compensation. The last effort made by the community who reject the amount of compensation is the deposit of compensation money in the local District Court because they have not filed an objection to the District Court and have overdue in submitting a letter of objection that has been determined in the legislation, which is 14 (fourteen) days after the deliberation on determining compensation.
