PERTANGGUNGJAWABAN HUKUM TERHADAP KONSUMEN YANG MENITIPKAN HEWAN PELIHARAANYA DI JASA PENITIPAN HEWAN PELIHARAAN (STUDI KASUS PET HOTEL X DI KOTA MALANG)

Nowadays, keeping animals has become a lifestyle that is quite popular and a trend among people. The owner has the obligation to maintain and care for the animal and the owner must also be responsible for the consequences that will arise from the animal. However, it is not uncommon for people to be unable to take care of their pets because of busy work. Therefore, business people see a business opportunity in the form of providing pet care services or what is usually called a Pet Hotel. With this Pet Hotel, pet owners are no longer confused about leaving their pets while they are busy working. In carrying out this custody, of course the Pet Hotel and the animal owner enter into an agreement which indirectly creates a legal relationship between the two parties. When carrying out day care, it is not uncommon for the Pet Hotel to experience problems with the animals such as illnesses and injuries. So this is the background for this research with the formulation of the problem of how the consumer agreement with Pet Hotel is contained, what legal issues arise, and what responsibility Pet Hotel has for animals that are injured or sick. The research method used is the empirical legal method. The types of data used are primary and secondary. Based on the results of research and discussion, it is stated that the contents of the agreement between consumers and Pet Hotel are procedural in nature. The legal problem that arose was a breach of contract committed by the Pet Hotel. Then for accountability, the Pet Hotel will be responsible in the form of treatment and care until it recovers if the animal's illness is caused by an error on the part of the Pet Hotel.
