KEKABURAN MAKNA KATA MENGUASAI DALAM PASAL 112 UNDANG-UNDANG NOMOR 35 TAHUN 2009 TENTANG NARKOTIKA

Article 112 of the Narcotics Law is included in an article that is considered to experience norm ambiguity because one of the word elements in the article, namely mastering, causes multiple interpretations. The similarity between the meanings of control and possession in the article results in uncertainty in its application. Many law enforcement officers have charged abusers with violating Article 112 because the concept of control in Article 112 is quite dominant. The proof in Article 112 is prioritized by the possession of narcotics without proving the elements of other acts. There are various interpretations related to the concept of control in Article 112. There is a need for proper legal interpretation to find out the meaning of the word that has been blurred. This research is conducted to find out the meaning of menguasai and provide an ideal formulation related to the basic concept of menguasai. The method used in this writing is normative-legal. The results of this study are the meaning of the word menguasai and the ideal concept related to the elements of the word menguasai that should be in Article 112.
