ANALISIS SURAT DAKWAAN DALAM PERKARA NOMOR 396/PID.B/2023/PN.MLG DIHUBUNGKAN DENGAN KETENTUAN PASAL 143 AYAT (2) KUHAP

Among the law enforcement organizations with the power to indict is the prosecutor's office. According to Article 143 paragraph (2) of the Criminal Procedure Code, there are formal and material requirements that must be fulfilled before an indictment can be made. Nonetheless, the author believes that the indictment in case registration number PDM-122/M.5.11/09/2023 does not meet the material conditions outlined in the Criminal Procedure Code. Based on this, the author took the initiative to make it the subject of a final project which aims to determine whether the indictment with the case registration number has met the requirements as stipulated in Article 143 paragraph (2) of the Criminal Procedure Code and to determine whether the indictment is in accordance with the material acts of the defendants. When working on the final project, the author employs an empirical juridical research methodology, examining whether normative legal provisions are implemented in every instance of a particular legal event that takes place in society. The discussion's primary focus is on how the Criminal Procedure Code's Article 143, paragraph (2) governs the indictment's requirements and the indictment's analysis, with case registration number PDM-122/M.5.11/09/2023. The author suggests that the prosecutor should be more careful in writing the indictment and pay attention to the requirements stipulated in the Criminal Procedure Code. In addition, if it is necessary to separate the files of the defendants, it should be done so as not to confuse the prosecutor in determining the charges.
