EFEKTIFITAS PENERAPAN PASAL 8 DAN 9 PERATURAN DAERAH KOTA MALANG NO 4 TAHUN 2020 TENTANG PENGENDALIAN DAN PENGAWASAN MINUMAN BERALKOHOL (STUDI KOTA MALANG)

This thesis focuses on knowing and explaining how the effectiveness of the implementation of articles 8 and 9 of Malang City Regional Regulation No. 4 of 2020 concerning the Control and Supervision of Alcoholic Beverages. And find out the factors that hinder the implementation of articles 8 and 9 of Malang City Regional Regulation No. 4 of 2020. The legal research method used is juridical socioligical by collecting primary data, secondary data, and tertiary data. The data collection techniques used are interviews, and literature studies. The data that has been collected is then analyzed and presented using a qualitative descriptive method. Based on the results of the analysis that has been carried out, the application of articles 8 and 9 of Regional Regulation No. 4 of 2020 concerning Control and Supervision of Alcoholic Beverages is still not effective, this is because there are still several places selling alcoholic beverages that are not in accordance with the provisions in articles 8 and 9, even though the Satpol-PP has conducted raids but there are still grocery stores that sell alcoholic beverages. And in the implementation of articles 8 and 9 of the Malang City Regional Regulation No. 4 of 2020 concerning Control and Supervision of Alcoholic Beverages, there are five factors that become obstacles, including the substance of the law that is less systematic, lack of law enforcement personnel, lack of facilities and facilities owned by the Satpol-PP, poor legal culture in society, and lack of public awareness. So to increase the effectiveness of the implementation of Regional Regulations, a sociological approach is needed by conducting counseling to the community in order to increase legal awareness in the community. And improvement is needed both from the governing substance, the quality of law enforcers, facilities, community culture, and community behavior.
