Abstract
In Indonesia, the death penalty is the most severe sanction among other sanctions, giving rise to pros and cons because the waiting period does not have legal certainty. Convicts sentenced to death wait up to a dozen years to be executed. So what are the factors that hinder the process of implementing the death penalty execution and what efforts should the government make to overcome this? This research uses analytical descriptive research with systematic analysis by explaining legal facts and regulations regarding the waiting period for the execution of the death penalty. This research was prepared using normative juridical methods by producing answers related to factors that hinder the length of the execution process for death row inmates, including the relatively high costs, complicated administrative processes, providing the rights of convicts such as requests to postpone the execution of convicts. , as well as the Constitutional Court's decision Number 2-3 PUU-V/2007 stating that all death sentences which have legal force remain immediately carried out. The phrase immediately in this case causes confusion in interpretation because it does not specifically mention the time limit for execution of death row convicts. Thus, law enforcers should make definite and firm regulations in regulating the period of death sentences for death row inmates so that a sense of justice, certainty and benefit of the law is firmly achieved. Apart from that, law enforcement officials, especially police, prosecutors and judges, are expected to build good mechanisms to increase cooperation in the legal sector so that there can be good communication to create legal order in Indonesia.
