STUDI KOMPARATIF METODE IJTIHAD FATWA MAJELIS ULAMA INDONESIA DAN BAHTSUL MASAIL TENTANG HUKUM MENGGUNAKAN PEWARNA MAKANAN DAN MINUMAN DARI SERANGGA COCHINEAL

There are differences of opinion in the legal determination of the Indonesian Ulema Council (MUI) and the Bahtsul Masail Institute of Nadatul Ulama (LBMNU) in the use of food and beverage dyes derived from carmin dyes. This paper will explain the methods used by the two institutions and analyse what methods are used by MUI and Bahtsul Masail. This research uses library research method with ushul fiqh approach.
The result of this research is that MUI in making ijtihad regarding food and beverage dyes derived from cochineal insects uses the type of ijtihad jama'iy and uses bayani, ta'lili and istislahi ijtihad methods. In the MUI fatwa, it states that the use of this dye is halal because this insect is similar to locusts. Meanwhile, Bahtsul Masail uses the type of ijtihad jama'iy with the Qouly ijtihad method. Referring directly to the opinions of previous scholars. Imam Nawani in his book states that insects are considered disgusting and food and drinks containing these insects are considered bad.
