Abstract

The industrial development of PT Makmur Elok Graha on Rempang Island ignores the rights of the Rempang indigenous people, especially regarding customary land. This research examines the position of indigenous peoples' land rights with the existence of Building Rights Title owned by PT Makmur Elok Graha on Rempang Island and legal protection for Rempang indigenous peoples with the existence of Building Rights Title owned by PT Makmur Elok Graha. The type of research used is normative juridical with material collection techniques through literature study. There is uncertainty in the status of land rights on Rempang Island due to a conflict of norms between Presidential Decree No. 41 of 1973 concerning the Batam Island Industrial Area and Batam Mayor Decree No. KPTS. 105/HR/III/2004 on the Determination of Old Village Area in Batam City became the root of the problem between the Government, Indigenous Peoples and PT Makmur Elok Graha. So that the need for a review of the regulations governing land rights in Rempang so as not to ignore the customary land of the indigenous people of Rempang.
