Pengaturan Hak Cipta Sebagai Jaminan Fidusia Serta Tantangan dan Peluang Hak Cipta Sebagai Jaminan Fidusia Di Indonesia

This research aims to analyze the legal protection of copyright as a fiduciary guarantee in Indonesia as well as the challenges and opportunities of copyright as a fiduciary guarantee in Indonesia in accordance with the applicable circumstances and regulations. This research is normative legal research which uses a statutory research approach and a comparative approach using primary legal materials such as legislation and secondary legal materials. The technique used in collecting legal materials uses library study techniques. Analysis of legal materials uses descriptive analysis or what is called qualitative data analysis techniques. According to the Regulation Number 28 of 2014 concerning Copyright in Article 16 paragraph (3) it is stated that copyright can be used as fiduciary guarantee. This encourages the government to regulate it further in Regulation Number 24 of 2019 concerning the Creative Economy and Government Regulation Number 24 of 2022 as the Implementing Regulation Number 24 of 2019. However, in reality there is a legal gap which creates legal uncertainty regarding copyright as a fiduciary guarantee which is an obstacle for banks and non-banking parties in implementing copyright as a fiduciary guarantee which to date has not been implemented properly.
