Abstract

The position of the case of the author of the study in the house on Muria Street began in February-March 2019 with an estimate of a debt and receivables agreement with collateral for a house on Muria Street, Malang City between "B" and "S". The debt collateral used by "B" originally came from the assets of "B" who had died, whose name was "H" and had changed the name to one of "B" and "H's children", finally the house on Jalan Muria was executed. . The research aims to determine the validity of the house sale and purchase agreement which is based on a debt and receivables agreement accompanied by PPJB (Case study of a house on Jalan Muria Malang, Malang City) and to find out the legal implications of the sale and purchase of a house based on debts and receivables accompanied by PPJB (Case study of a house on the street Muria Malang City) The author's research method uses sociological empirical with the author's facts through direct observation of human behavior in the field (application of law in society). The approach, apart from field observations, also uses primary data, with sources obtained through observation, interviews with debtors, heirs, correspondents and observing research objects. As a complement to the report-based research, the author includes secondary data sources obtained from journals, documents, books, laws and websites, so that legal materials can be analyzed qualitatively. Data obtained in the field, literature study, information is presented descriptively, so that a clear picture is obtained as a whole. The results of the research were that the house sale and purchase agreement was invalid, because the certificate of inheritance was without the consent of the heirs, the imposition of loan interest was not in accordance with the regulations, the parties in the transition process were incompetent, there was a PPJB being made on the debt and receivables agreement, the mismatch between the selling price of the house and the market price, and discrepancy between the price stated in the PPJB and that received by the seller, premature PPJB, transfer of objects to be pledged as collateral to the Bank without the heirs knowing. The implication is that it has violated the terms and validity of the agreement, which is categorized as an unlawful act.
