ANALISIS PUTUSAN N0.738/PDT.G/2012/PN.JKT.SEL TENTANG PENOLAKAN KLAIM ASURANSI JIWA

This article aims to find out and analyze Decision Number 738/PDT.G/2012/PN.JKT.Sel regarding the rejection of life insurance claims by PT. Commonwealth Life which is caused by untruth and dishonesty in filling the health data carried out by the insured when entering the life insurance agreement. The method used in writing this final assignment is a normative legal research method with legal material collection technique used in this analysis is document study, and the legal material is analyzed through evaluation, interpretation, argumentation, and descriptive. The conclusion of this writing is that the defendant’s action in refusing to submit the plaintiff’s life insurance claims repeatedly, based in the reason of that the insured had lied in filing the health data when entering the life insurance agreement guilty of committing an act of breach of contract. However, if you look at the existing Insurance Policy, the insurance company actually has the right to terminate the insured’s life insurance if its proven that there is dishonesty or error in filling the personal data and health data that was filled in by the insured when entering into a Life Insurance Agreement.
