Abstract
The procedural implementation of Civil Procedure Law at the first level involves stages like filing a lawsuit, responding, presenting counterarguments, providing evidence, concluding, and issuing a judgment. Field research focused on case 1674/Pdt.G/2023/PA. Mr., an annulment case with the plaintiff NF and late defendant HS. NF sought annulment due to a formal defect in the marriage certification between HS and the defendant, unknown to NF as HS's legal wife. The socio-legal research method used data from an internship at Oke Law Firm | eko & co and literature. The resolution process includes special power delegation, lawsuit filing, response, and final judgment.
In the court context, the study highlights inconsistencies between procedural law and judges' decisions, especially in negligence during trial procedures not aligned with Civil Procedure Law. Differences in legal consequences between legal considerations and judges' decisions create inconsistency. Further assessment, particularly regarding evidence procedures not complying with civil procedure law, can be evaluated by the Supreme Court Supervisory Board. The examination aims to ensure integrity, fairness, and legal certainty in judgments. It verifies that the evidentiary process aligns with regulations.
