Abstract
The freedom of lawyers in carrying out their professional duties without worrying about external pressure or legal actions that impede is the main focus of the existence of lawyer immunity. This research discusses lawyer immunity based on the case study of Decision Number 1/Pid.Pra/2023/PN.Bon, which focuses on understanding the guarantee of the use of lawyer immunity and the implementation of lawyer immunity. As stated in Law Number 18 of 2003 concerning Advocates, Article 16 explains that lawyers cannot be sued both criminally and civilly, but in practice, lawyers are often treated as suspects due to their profession in defending clients. The lack of clarity on the limits to protect lawyers as long as they act in good faith in carrying out their professional duties causes lawyer immunity to be often overlooked in its function and usage, becoming one of the obstacles for lawyers to defend their clients. This research uses a normative juridical method with reference to Law Number 18 of 2003 concerning Advocates. Some reviews, such as legal certainty, are considered to understand the use and implementation of lawyer immunity. Based on the existing urgency, the guarantee and implementation of lawyer immunity do not comply with the regulations made to protect lawyers from claims due to the work they do to defend their clients.
