Abstract
The Narcotics Law mandates that drug abusers undergo rehabilitation. Thus the Indonesian National Police made a policy by enacting Police Regulation No. 8 of 2021 concerning Handling Crimes Based on Restorative Justice. However, the number of cases resolved through restorative justice by the Drug Investigation
Unit of Malang City Police is still relatively low. Based on this, the problem of this research is "How is the handling of drug abuse crimes through restorative justice based on Police Regulation No. 8 of 2021 by the Malang City Police Drug Investigation Unit? And what are the obstacles faced in handling criminal acts of drug abusers through restorative justice based on Police Regulation No. 8 of 2021 by the Malang City Police Drug Investigation Unit?" The purpose of this research is to find out how the handling and obstacles faced in its implementation. The method used in this research is using qualitative method. Based on the qualitative
method, the technique of collecting legal materials is carried out by interview and observation techniques at the Malang City Police Drug Detection Unit. The result of this research is that in handling abusers must meet special requirements by proving to be abusers who apply for rehabilitation, with evidence of 1 day's use in accordance with the legislation or if without evidence, positive urine test results. In addition, it is proven that they are not involved in networks, dealers or bookies, the TAT process has been carried out and they are willing to cooperate with police investigators. In its implementation, this is constrained by adjustments as a new regulation and the perpetrator does not want to cooperate. That way the author suggests continuing to involve the family and the perpetrator in the solutions that can be taken and correcting the existing shortcomings
