KAFĀ’AH DALAM PERNIKAHAN (STUDI KOMPARASI AL-MAWARDI DAN IBNU QAYYIM AL-JAUZI)

The background of this research is to examine and compare the views of two prominent scholars in the field of fiqh, namely al-Mawardi and Ibn Qayyim al-Jawzi, on the concept of Kafā’ah in marriage. Kafā’ah is the equality between the prospective husband and wife in terms of lineage, religion, profession, wealth, and physical appearance. This concept is related to the rights and obligations of each party in marriage, as well as its impact on the harmony of the household. This research aims to find out the similarities and differences between al-Mawardi and Ibn Qayyim al-Jawzi's views on Kafā’ah in terms of concept, characteristics, legal basis, and analysis of the istinbāṭ method. This research uses a qualitative research method and a qualitative literature research type. The primary sources used are books from al-Mawardi, namely al-Ḥāwī al-Kabīr, and Zād al-Ma'ād, which is a work by Ibn Qayyim al-Jawzi. The data collection technique in this research uses document study. The data analysis technique used in this research uses two analysis techniques, first using descriptive analysis technique and second using comparative analysis technique. The results of this study show that the concept and characteristics of Kafā’ah possessed by al-Mawardi and Ibn Qayyim al-Jawzi have little similarity in concept and a significant difference in characteristics. While the comparison of legal basis and istinbāṭ method has a very significant difference.
