Abstract

The practice of Deeds of Sale and Purchase (APJB) in land purchase transactions in Indonesia still often gives rise to legal issues, one of which is due to unclear agreement clauses, especially regarding the absence of a payment repayment period. This ambiguity has the potential to trigger prolonged disputes that culminate in a lawsuit for breach of contract, as occurred in Supreme Court Decision Number 602 K/Pdt/2020 which overturned a lower court decision on the grounds that the payment repayment period was not stated in the APJB. Using a normative juridical method, this research will examine the judge's legal considerations regarding the lawsuit for breach of contract in land sale and purchase in Decision Number 602 K/Pdt/2020 and the legal consequences arising from the omission of a payment repayment period in the Deed of Sale and Purchase (APJB) in the decision. The normative legal approach was conducted through a study of primary legal materials including Articles 1320, 1457, and 1540 of the Civil Code and Supreme Court Decision Number 602 K/Pdt/2020, supported by secondary legal materials in the form of scientific journals, law books, and relevant theses. The results of the study indicate that the Supreme Court considers the absence of a repayment period to result in the agreement not fulfilling the element of object certainty so that the default lawsuit cannot be granted. This study emphasizes the importance of explicitly including a repayment period clause in every APJB to ensure legal certainty and protect the rights of the parties.
