Abstract
The wage gap among laborers is one of the forms of Human Rights violations (HRV) that affect equality and non-discrimination in the workplace. This research aims to analyze the implementation of ILO Convention No. 100 of 1951 and how the phenomenon of the wage gap among laborers in the socio-legal context, explaining its causative factors, and providing recommendations to address this issue. The research method used is a socio-legal approach involving legal analysis and social data. This research indicates that the implementation of this ILO Convention has been applied in nearly all companies in Indonesia, but not comprehensively by all companies based on the research conducted by the author. Additionally, the wage gap among laborers occurs due to various factors, including gender discrimination, differences in education, work experience, job loyalty, and job quality itself. Through a socio-legal approach, legal analysis identifies that the wage gap among laborers violates the principles of equality and non-discrimination recognized in national and international law, including HRV. The discussion highlights the need for the government to strengthen wage policy to ensure wage equality between male and female laborers. Companies should also review their wage policies and adopt transparent and fair practices. Furthermore, it is essential to raise awareness and education about the wage gap among laborers and promote an inclusive organizational culture. To address this issue, the government needs to strengthen law enforcement and raise awareness. Recommendations from this research are that the government should enhance oversight of the fair wage policy implementation and enforce the law against wage gap violations. Companies should actively evaluate and adjust their wage policies, as well as create an inclusive and fair working environment for all laborers.
