In this case, the evidentiary agenda in civil cases is crucial for the judge's assessment of the presented evidence, which will closely relate to the regulations regarding evidence based on the submitted proof. In divorce cases, many people use electronic documents as evidence to prove disputes and conflicts within the household. In this context, the author analyzes the evidentiary process of a divorce case with Case Number 3419/Pdt.G/2023/PA.JT using electronic documents without the presence of digital forensics. In empirical legal research, the focus of the author's study is on the functioning of law in society. Similarly, electronic evidence submitted by the respondent was set aside by the panel of judges because its integrity was not proven, as stipulated by the provisions in Law Number 19 of 2016 concerning Electronic Information and Transactions. The author suggests that the government promptly establish regulations regarding the procedural requirements for submitting electronic document evidence in religious court proceedings to provide legal certainty.
