Abstract
The development of information technology and the use of social media in the distribution of job vacancies increases the risk of fraud that is detrimental to job seekers. This study aims to analyze legal protection for victims in Decision Number 795/Pid.Sus/2023/PN Jkt.Tim reviewed from Article 17 juncto Article 62 of Law Number 8 of 1999 concerning Consumer Protection and analyze the judge's legal considerations based on the principle of justice. The method used is normative legal research with a statutory approach and a case approach through analysis of court decisions. The results of the study indicate that the victim can be qualified as a consumer of information services, while the defendant fulfills the elements of a business actor because he offered job placement services to gain profit. The distribution of fictitious job vacancies through social media is a form of misleading information and contradicts consumer protection provisions. The legal protection provided in the decision still focuses on criminal penalties based on the Electronic Information and Transactions Law so that the recovery of victims' losses has not been optimally fulfilled. Law enforcement needs to integrate the application of the Consumer Protection Law with the Electronic Information and Transactions Law so that victims receive more comprehensive protection. Judges in similar cases are expected to place greater emphasis on substantive justice by considering restitution of the victim's losses as part of the sentencing objective.
