PENYELESAIAN TINDAK PIDANA KEKERASAN TERHADAP ANAK PADA NOMOR REGISTRASI PERKARA 7/PID.SUS-ANAK/2022/PN Mlg

Criminal law is the law that determines criminal acts and determines the guilt of the offender (the substance of criminal law) and the law that determines the implementation of the substance of criminal law (criminal procedure law). In Indonesia, criminal law is divided into two types, namely general criminal law such as theft, murder, insult, and others, and special criminal law, one of which is juvenile crime. The juvenile criminal system is the entire process of resolving cases of children who are faced with the law. In this research, the researcher then wants to discuss the analysis of das sein and das sollen of the process of resolving criminal cases of children who commit violence against children. This study aims to determine and analyze the implementation of the settlement of cases of violence against children themselves. By using a juridical sociological research method in which research is carried out by examining the applicable laws and what happens in the field, then identifying problems and then looking for problem solving, in the end differences and similarities will be found from the normative description with the actual situation in the field. The researcher gives advice to all parties so that in the implementation of case settlement must consider various things including legal certainty, legal justice, and legal benefits for all parties.
