Abstract

This study aims to analyze the forms of legal protection for consumers in online buying and selling practices through the Shopee platform, specifically in Ngoro District, Jombang Regency. The background of this research is based on the rapid development of trade through electronic systems that provide transaction convenience, but also give rise to various legal issues that have the potential to harm consumers, such as product mismatch with description, late or failed delivery, and fraudulent practices in digital transactions. This study uses a sociological juridical method with a qualitative descriptive approach, namely examining applicable legal provisions and linking them to empirical facts in the field through interviews and literature studies. The results of the study indicate that legal protection for consumers in online transactions has been regulated in various laws and regulations, including the Consumer Protection Law, civil law provisions regarding agreements, and regulations for trade through electronic systems. However, in practice, various violations are still found, indicating the suboptimal implementation of these legal norms. The responsibility of business actors is generally related to default due to failure to fulfill performance as agreed, while the platform plays a role as an electronic system organizer that is obliged to provide mechanisms for transaction security, complaints, and dispute resolution.
