Abstract

his study examines consumer protection against the misuse of e-wallet accounts on the DANA application, particularly in relation to data theft and fraud that result in financial losses for users. Normatively, consumer protection is regulated under the Consumer Protection Law. The research employs an empirical juridical method through a statutory approach, conceptual analysis, and interviews with users who experienced account breaches. The findings indicate that users suffer losses due to actions committed by irresponsible parties, highlighting the necessity of adequate security systems as a form of legal protection provided by e-wallet operators. The responsibility of providers in safeguarding users’ data and funds is crucial, especially when losses arise from weaknesses in the DANA system. The study also reveals that dispute resolution for account misuse can be pursued through three mechanisms: internal settlement by the provider, resolution through the Alternative Dispute Resolution Institution (LAPS), and settlement through the court (litigation). Non-litigation mechanisms through LAPS offer a faster alternative but still require strengthening to ensure legal certainty for consumers.
