ANALISIS PELAKSANAAN PROSES PENYELESAIAN SENGKETA TANAH DI DESA SAPTORENGGO KABUPATEN MALANG DALAM PERKARA NOMOR 34/PDT.G/2023/PN.KPN

The Deed of Sale and Purchase (AJB) is an authentic deed of the Land Deed Making Officer (PPAT) which is expected to provide certainty and legal protection in land and building sale and purchase transactions. AJB by PPAT becomes inauthentic if it contains legal defects such as the identity of one of the parties being falsified. As happened in case number 34/Pdt.G/2023/PN.Kpn. The aim of the research is to determine and analyze the implementation of the land dispute resolution process in Saptorenggo village, Malang Regency in case number 34/Pdt.G/2023/PN.Kpn. The research method is in the form is a empirical juridical, using data collection techniques of interviews, observation, documentation and document study. The results of this research are that land dispute resolution was resolved through litigation in accordance with the flow of civil procedural law trials, and the panel of judges declared that AJB whose identity was falsified and its derivative deeds were declared invalid and had no legal force and the Defendant was declared to have committed an unlawful act. This is a suggestion for the public to better understand how to obtain land rights according to applicable Indonesian law. Second, the official who has the authority to issue an authentic deed regarding land, PPAT must be careful and careful because he is faced with a legal action to prevent the emergence of another authentic deed due to the existence of a fake AJB identity issued from the PPAT.
