Abstract

Cryptocurrency, as an asset with high volatility, has attracted considerable interest, even after the pandemic, and has become very popular among people not only internationally but also nationally, as if it were a contagious disease spreading rapidly. However, to address this crazy phenomenon, which involves many human needs, this instrument needs to be reviewed more deeply in terms of regulations and certainty that can be guaranteed in the event of fraud and abuse that is illegal and materially detrimental. Based on Law No. 11 of 2008 concerning Electronic Information and Transactions, Bappebti Regulation No. 8 of 2021 concerning the Determination of a List of Crypto Assets that can be Traded on the Crypto Asset Market, and OJK Regulation No. 27 of 2024 concerning the Implementation of Digital Financial Asset Trading, Including Crypto Assets, there is uncertainty in the delisting procedure and its legal framework. Using a statute approach and conceptual approach will be directly proportional to the type of normative-juridical research using descriptive-qualitatif analytical techniques, resulting in a progressive solution with the application of law in the making and more informative and innovative procedures. Using a progressive legal approach through the establishment of a fair delisting mechanism and the creation of a smart contract auditor, which should be at the heart of the crypto trading system, with the hope of providing preventive measures to bring about regulation and legal certainty.
