Abstract
The research was motivated by observations of health crimes involving distribution of pharmaceutical preparations that did not have a distribution permit, case study case number 177/Pis.Sus/2023/PN Bil at the Bangil District Court. This description describes which parts of the criminal procedural legal process are held in the District Court. The aim of this research is to provide an overview of the process at the Bangil District Court in handling health crime cases involving distribution of pharmaceutical preparations that do not have a distribution permit. The research method used is Socio Legal which is based on the Empirical Juridical type of research. This research was carried out directly in the field and was linked to applicable laws, one of which was Law Number 36 of 2009 concerning Health. The result of this research is that a criminal sentence was imposed on the defendant with a prison sentence of 1 (one) year and a fine of Rp. 5,000,000 (five million rupiah) with the provision that if the fine was not paid, it would be replaced by imprisonment for 1 (one) month. In the process of resolving the case to produce a verdict, the Judge uses the second indictment from the Public Prosecutor as a reference for deciding the case, not a prosecution. The charges violate Article 197 in conjunction with Article 106 Paragraphs (1) and (2) of the Law of the Republic of Indonesia Number 36 of 2009. Apart from that, there are things that the judge takes into consideration in deciding the case, which can be divided into 2 ways, namely judicially and non-judicially. juridical. From this research, you should be careful when buying medicine. It is better to first consult a competent person such as a doctor, nurse or pharmacist and choose a drug that is BPOM certified to ensure its safety and usefulness.
