PENYELESAIAN PERKARA TINDAK PIDANA PENGANIAYAAN MELALUI RESTORATIVE JUSTICE PADA PERKARA NOMOR LP/B/11/I/2023/SPKT/POLSEK DAMPIT

Researching persecution criminal cases through restorative justice. What legal objectives are achieved and whether they fulfill legal effectiveness. In this research, namely using empirical juridical research methods which in other words is a type of sociological legal research and can also be called field research, namely examining the applicable legal provisions and what happens in reality in society. Or in other words, a research conducted on the actual situation or the real situation that occurs in society with the intention of knowing and finding the facts and data needed, after the required data is collected then go to problem identification which ultimately leads to problem solving. This research is empirical research, because the researcher wants to know the effectiveness of the actions taken by the authorities in the case. Restorative justice produces public welfare and includes all legal objectives and legal effectiveness. Restorative justice is a settlement of cases outside the court as a useful alternative.
