ANALISIS PENANGANAN PERKARA TINDAK PIDANA KEKERASAN TERHADAP ANAK DIBAWAH UMUR STUDI KASUS PERKARA NOMOR 51/PID.SUS/2023/PN.BIL

Violence against children is not a new phenomenon, but unfortunately, to date, these cases continue to occur even tend to increase every single year. One of the interesting and controversial cases’s handled by EP Law Firm is related to violence against children. As a Legal Advisor to the defendant on behalf of WARIH ARIBOWO Bin BAMBANG EKO NURYANTO (Defendant). This case was adjudicated at the Bangil District Court. The aim of this research is to understand how to resolve the case of violence against children in study case number 51/Pid.Sus/2023/PN BIL. The researcher uses empirical juridical research and uses a socio-legal study approach, so that it is not only limited to normative texts. The results of this research illustrate that resolving cases included legal steps such as focussing justice, both in protecting children's rights and fulfilling the rights of defendants. Some of these process involved the juvenile criminal justice system and criminal procedural law. The aim of resolving this case is to seek and obtain material truth, which is obtained based on the process that have been accomplished so that it has been proven that material truth has been achieved in resolving this case. The recommendations that researchers could provide is evaluating the factors that cause an increase the violence against children, so that they could decreased or reduce violent crimes against children.
