Abstract

This legal research aims to understand and describe the legal protection of the jersey of PT. Arema Aremania Bersatu Berprestasi Indonesia whose brand has been registered according to Law Number 20 of 2016 concerning Trademarks and Geographical Indications, and aims to analyze the similarities in principle between the jersey branded PT. Arema Aremania Bersatu Berprestasi Indonesia and the same product circulating in the market. This legal research is based on legal protection related to brands as regulated in Law Number 20 of 2016 concerning Trademarks and Geographical Indications. The method used in this research is the normative juridical method with a statutory, conceptual, and case approach. The results of this research, that the jersey of PT. Arema Aremania Bersatu Berprestasi Indonesia obtains legal protection referring to Law Number 20 of 2016 concerning Trademarks and Geographical Indications through trademark registration at the Directorate General of Intellectual Property Rights. Imitation of jerseys that have dominant similarities such as brand logos, apparel logos, main sponsor logos, jersey fabric motifs, jersey stitching patterns, jersey collar shapes, and jersey originality labels normatively fulfill the element of similarity in principle. The conclusion of this study states that legal protection for brands is regulated in a preventive and repressive manner. The suggestion in this study is that preventive legal protection does not stop at the administrative side alone but is followed by a repressive and adaptive manner to keep up with the times, and exclusive rights to brands are fully utilized to close the gap for imitation.
