TINJAUAN YURIDIS KEABSAHAN PEMBUKTIAN KETERANGAN SAKSI MELALUI MEDIA TELECONFERENCE DALAM SISTEM PERADILAN PIDANA DI INDONESIA

The State of Indonesia as outlined is a democratic legal state based on Pancasila and the 1945 Constitution by upholding human rights and guaranteeing equal and equal status for every citizen in law and government. With the existence of various kinds of evidence that the rapid development of the era arose a problem that the position of the evidence known as teleconference can be used as one of the evidence supporting the trial. This study uses a normative juridical approach research method, which means seeing the law as a norm in society that views a problem as more than the formal legal approach through the Legislation approach and the case-example approach that has ever existed in Indonesia. After all the legal materials were collected, the researcher analyzed the legal rules and theories. Based on the results of research and discussion, according to the provisions of the Criminal Procedure Code (KUHAP) Article 160 Paragraph (1) letter a, this provision requires the physical presence of witnesses before the trial, but the physical presence before the trial. So the examination of witnesses through teleconference also includes direct and oral examination of judges. Suggestions from this research The government should immediately ratify the draft of the Indonesian criminal code of law, especially in the provision of witness statements through electronic media, no more issues in the future.
