Abstract
Fictitious credit is an attempt to borrow money using another person's identity with the aim of obtaining credit facilities in another person's name. The rise of fictitious credit is very scary if it often happens because this incident is detrimental to several parties. The aim of this research is to see and observe the process of resolving Fictitious Credit cases in the First Level Court at the Bangil Class 1B District Court. In this research, the author uses a juridical-empirical approach method, which is a legal research regarding the application or implementation of normative legal provisions directly in every legal event that occurs. This research generally examines legal behavior in society which can be linked to law and the source of information (data) obtained comes from primary data or data obtained from society directly. In criminal cases, material truth is the main focus and the essence of the conference is in terms of evidence. Evidence can be the main basis in determining the outcome of criminal justice, and the principle of the presumption of innocence requires that criminals be presumed not to have committed a crime unless proven otherwise. The credibility of witnesses in the examination process is a key factor in assessing the value of the evidence presented in court. For this reason, in general, the trial shows that the events, the evidentiary process, and the testimony of witnesses are very important. Researchers hope that the entire justice system wherever it is located will continue to strive for legal justice based on facts.
