PERTANGGUNGJAWABAN HUKUM PENJAGA PARKIR ATAS KEHILANGAN KENDARAAN (STUDI TEMPAT PARKIR DI KOTA MALANG)

The loss of vehicles in parking areas is a legal problem that often occurs and causes losses to the community. This research aims to analyze the legal regulations regarding the criminal liability of parking guards for lost vehicles based on applicable laws and the application of legal responsibility of parking guards in cases of lost vehicles in Malang City. The research method used is empirical juridical with a sociological juridical approach, through literature study and field research in the form of interviews and observations. The research results show that the criminal liability of parking guards is not automatic, but depends on the presence of an element of intent or negligence. In practice in Malang City, the applocation of legal responsibility is different between official and unofficial parking, where the compensation mechanism for official parking is not yet optimal, while unofficial parking tends to be resolved amicably so that legal certainty for consumers is still weak.
