Abstract
This research focuses on respecting the rights of parties in the purchase and sale of housing. This is a research that has been designated as the main object of the researcher due to the increasing increase in the real estate sector, but it turns out that there are still cases of developers who promise that housing will be built immediately if payment is made as promised by the developer, but only sweet promises without any fulfillment which led to default on the sale and purchase of housing under the jurisdiction of the Kepanjen District Court. The case of real estate developers who do not respect their objectives can lead to losses for consumers. Parties should be aware of the rights and efforts that can lead to a more smooth home purchase and sale. This research was carried out to determine the resolution of cases regarding compliance with the rights of parties in the sale and purchase of housing with registration number 50/Pdt.G/2023/Pn Kpn regarding defects committed by sellers or the second parties, as well as guaranteeing the rights of both parties in the sale and purchase of housing, carried out by the plaintiff and the defendant. The method used in this research is empirical legal legal research by analyzing written laws from library materials or secondary data and carrying out research directly in the area where the studied object is located. The results of this research show that consumers take legal action to demand compensation from real estate developers for the non-completion of housing construction. The case in this study tried to be resolved outside the court but did not achieve results but it was resolved in court and eventually made peace, a peace letter was issued (Van Dading ). This was agreed by both parties.
