Abstract
In the practice of buying and selling land in Indonesia, disputes often arise due to unclear status of the land object being traded, especially when the land is claimed as an object of dependent rights but has not been officially registered with the National Land Agency (BPN). This condition creates legal uncertainty for well-meaning buyers and often leads to disputes in court. The problems studied in this study are how to resolve disputes over the sale and purchase of land that are claimed to have dependent rights, as well as what is the basis for legal considerations of the panel of judges in deciding the invalidity of the dependent rights. The main issue raised is the failure to apply the principle of publicity in the registration of dependent rights, thus causing conflicts between creditors and buyers. The research method used is an empirical juridical method with an emphasis on the study of legal phenomena that occur in society. The author uses primary legal materials in the form of Decision Number 58/Pdt.G/2024/PN Sng and interviews with advocates at the SSP Law Firm who handle this case, as well as secondary and tertiary legal materials as support for primary data. The writing of this final project discusses the dispute resolution process from the initial stage to the decision, as well as the analysis of the legal considerations of the panel of judges who won the buyer in good faith. The decision emphasizes that the rights of dependents who are not registered have no legal force, so they cannot be used as a basis for canceling land purchase and sale transactions.
