Abstract
This study is based on the growing public demand for vehicle rental services as a flexible and practical solution for mobility, particularly in urban areas and tourist destinations. Vehicle rental has become an alternative for people who need transportation without the obligation of vehicle ownership. However, alongside the growth of the vehicle rental business, legal issues have also emerged—especially hose related to breach of contract (wanprestasi) and misuse of rented vehicles by
renters. The three cases examined in this study, involving El-Nusa Rentcar and Jacktrans Tour & Travel, highlight significant gaps in the implementation of rental agreements. Although these agreements were administratively complete, violations still occurred. The element of trust between rental providers and renters proved insufficient to prevent contract breaches such as embezzlement or unauthorized
transfer of vehicles to third parties. This research uses an empirical juridical method with a qualitative approach, conducted through direct interviews with vehicle rental business operators. The findings indicate that El-Nusa Rentcar applies strict administrative procedures, such as requiring multiple forms of identification and vehicle collateral. In contrast, Jacktrans Tour & Travel emphasizes the use of digital contracts and GPS-based vehicle tracking technology. Dispute resolution in these cases is generally carried out through non-litigation
means, such as internal mediation and direct negotiation with the renter, in an effort to maintain business continuity and preserve good relations with customers. Based on these findings, the study recommends: the need to develop standardized rental agreements with clear legal force; increased legal education for prospective
renters to ensure they understand their rights and obligations; and the enhanced use of identity verification systems and vehicle tracking technology to prevent misuse.
