Abstract
This study aims to examine the basis for the implementation of public parking related to the protection provided to motor vehicle owners in the event of loss and damage. This study discusses the implementation of public parking for motor vehicles and the protection provided to motor vehicle owners by parking managers for lost and damaged motor vehicles in public parking lots in Batu City. The method used is sociological juridical legal research with data collection techniques in the form of interviews and documentation. The data sources used are primary data sources, secondary data sources, and tertiary data sources, with data analysis techniques using qualitative descriptive. The results of this study indicate obstacles in the implementation of public parking due to the failure to fulfill the obligations of parking attendants as managers in carrying out their duties. Parking attendants do not provide the number of tickets according to the entry and exit of vehicles, intending that some of the money goes into their own pockets, because the system for calculating deposit revenue is based on the remaining tickets held by the parking attendants. This obstacle has a major impact on the protection provided to motor vehicle owners, because tickets are one of the main requirements for obtaining protection. Users of public parking services can lose the right to compensation when they do not have a ticket, the ticket is fake, or the ticket has passed the deadline. If all requirements are met, the vehicle owner will only receive 20 percent of the loss at the time of the incident, and the loss will be fully covered by the parking attendant. Therefore, increased oversight of parking attendant obligations is needed to ensure the protection of parking service users.
