Abstract

This research focuses on analyzing the changes in the mechanism of public participation in environmental management following the enactment of Law Number 6 of 2023 concerning the Stipulation of Government Regulation in Lieu of Law Number 2 of 2022 on Job Creation (UUCK), viewed from the perspective of the participatory principle in environmental law. The UUCK introduced significant alterations to the framework of community participation previously regulated broadly under Law Number 32 of 2009 on Environmental Protection and Management (UUPPLH). These changes raise legal concerns regarding the extent to which the participatory principle remains upheld within the new regulation. The research problems are formulated as follows: (1) What are the forms of change in the public participation mechanism in environmental management before and after the enactment of the UUCK? and (2) To what extent are these changes consistent with the participatory principle in Indonesia’s environmental law? This study employs a normative legal research method using statutory and conceptual approaches. Primary legal materials include the 1945 Constitution of the Republic of Indonesia, the UUPPLH, the UUCK, and their implementing regulations. Secondary materials are drawn from literature, academic journals, and prior studies. The analysis was conducted descriptively and qualitatively to interpret and evaluate the relevant legal norms. The findings reveal that the UUCK has narrowed the scope of public participation in terms of eligible actors, procedures, and access to information. Participation is now limited to communities directly affected by environmental decisions, reducing the public’s role as a social control and supervisory force. Juridically, these changes are not fully aligned with the participatory principle, as they weaken transparency, accountability, and meaningful community involvement in environmental decision-making.
