Abstract
The purpose of this study is to analyze the implementation of compensation payment fulfillment in accordance with Government Regulation (PP) No. 35 of 2021 at PT X, as well as to analyze the obstacles and efforts made by PT X in implementing the compensation payment. The research method used is empirical legal research, with primary and secondary data sources.The results of the study show that PT X did not fulfill its obligations, namely by failing to provide compensation payments to fixed-term employment (PKWT) workers after the expiration of their contracts. PT X can be declared to have violated Article 15 paragraph (1) of Government Regulation No. 35 of 2021, which stipulates that employers are required to provide compensation to workers under fixed-term employment agreements. PT X may be subject to administrative sanctions under Article 61 of Government Regulation No. 35 of 2021, which include written warnings, restrictions on business activities, temporary suspension of part or all production tools, and freezing of business activities—with such sanctions being imposed gradually. PKWT workers may also file a request for the fulfillment of their compensation rights to PT X or take legal action. Factors hindering PT X from fulfilling its obligations include financial unpreparedness due to low income and the absence of budget allocation for compensation payments, as well as a lack of understanding of labor regulations, particularly concerning the implementation of compensation for PKWT workers. Therefore, company management should be proactive in keeping up with the latest labor regulations and establishing good relations with the labor office to ensure compliance with regulations and stay informed about policy changes. Furthermore, the company should engage in more thorough financial planning by allocating specific funds for PKWT workers’ compensation payments in accordance with the provisions of Government Regulation No. 35 of 2021.
