Abstract

Alcoholic beverages pose serious health and social problems, particularly
in Malang City, where illegal distribution fuels criminality and state losses. Despite
Malang City Regulation No. 4 of 2020 on licensing, unlicensed sales remain
prevalent. This study examines factors influencing alcoholic beverage licensing and
distribution, alongside obstacles in Malang City's licensing process. The research's
urgency stems from the continuous negative impacts of illegal alcoholic beverage
distribution on public order, health, and safety, emphasizing the critical need for
improved licensing and law enforcement. Employing a descriptive qualitative
approach, primary data was gathered from interviews with the Malang City
Department of Cooperatives, Industry, and Trade, complemented by secondary data
from legal documents and literature, analyzed descriptively. Licensing factors
include legal aspects, law enforcement, facilities, and public perception. Key
obstacles are differing public views, complex regulations, and suboptimal
supervision and enforcement. The Malang City Government should facilitate
ongoing stakeholder dialogue and enhance oversight of alcoholic beverage
distribution—legal and illegal—through consistent law enforcement and reinforced
inter-agency cooperation.
