Abstract

Legal protection for children with disabilities who are victims of sexual violence is a critical issue that intersects justice, human rights, and state responsibility. These children face double vulnerability both as minors and as individuals with physical, mental, or intellectual limitations making them frequent targets of sexual abuse. In Malang City, the rising number of sexual violence cases against disabled children highlights the urgent need for a more comprehensive and responsive legal protection framework. This study formulates two main problems: (1) What forms of legal protection are provided by the Social Service P3AP2KB of Malang City for children with disabilities who are victims of sexual violence? (2) What obstacles are encountered in implementing such protection? The research employs a socio-legal approach, combining field observations with legal analysis. Data collection techniques include structured interviews with the Head of the Women and Children Protection Unit (UPT PPA) and documentation. Primary data were obtained directly from field interviews, while secondary data were sourced from legislation, academic literature, and credible online resources. Theoretical foundations are drawn from the legal protection theories of Satjipto Rahardjo, Setiono, and Philipus M. Hadjon, alongside human rights and non discrimination principles enshrined in Law No. 8 of 2016 on Persons with Disabilities and Law No. 35 of 2014 on Child Protection. Findings reveal that the Social Service P3AP2KB provides legal protection through complaint reception,
outreach, case management, mediation, temporary shelter (safe house), psychological and legal assistance, and court support. However, implementation faces challenges such as limited disaggregated data on disabled children, shortage of specialized personnel, and persistent societal stigma. The study concludes that while structural and functional efforts have been made to protect disabled child victims of sexual violence, systemic improvements are still needed. Recommendations include strengthening institutional capacity, improving data collection, providing specialized training for support staff, and conducting public awareness campaigns to eliminate stigma and promote the rights of children with disabilities.
