Abstract

This study aims to analyze the factors causing the high divorce rate in the Sumenep Religious
Court. This study uses a qualitative approach with a case study method that focuses on
empirical sociological legal data on divorce filings at the Sumenep Religious Court from 2020
to 2022. Based on the research, the dominant factors causing the high divorce rate are
persistent disputes, economic problems, neglect by one party, and domestic violence (KDRT).
Prolonged disputes are rooted in the inability of couples to manage conflict, poor
communication, and unstable economic pressures. In addition, the phenomenon of infidelity,
exacerbated by advances in communication technology, is also a significant factor. Data also
shows that divorce suits are more often filed by wives (divorce lawsuits) than divorces by
husbands, indicating women's awareness of taking legal action regarding domestic problems.
The Sumenep Religious Court has attempted mediation to reduce the divorce rate, but the
results have been limited, with a reconciliation success rate of only around 1%. This study
recommends enhancing family outreach and mentoring programs, improving family
economic conditions, and enhancing mediation capacity in the Religious Court to reduce the
divorce rate in Sumenep Regency. These findings are important as a basis for regional
policies to protect and improve the quality of households in the community.
