Abstract

Food safety is a crucial aspect of consumer protection, especially in the ready-to
eat food sector. This study aims to analyze the implementation of Article 2 of
Government Regulation No. 86 of 2019 on Food Safety by MSMEs in Klojen
Market, Malang City and to examine the role of the Malang City Health Office in
addressing challenges in implementing this regulation. This research employs an
empirical legal method, utilizing interviews and literature studies on food safety
policies and consumer protection. The collected data were analyzed descriptively
and qualitatively using a regulatory and food safety theoretical approach. The
findings indicate that the implementation of food safety regulations by MSMEs
faces multiple challenges, particularly in supervision, education, and compliance
among business actors. The Malang City Health Office plays a crucial role in
oversight; however, in practice, monitoring remains limited due to a lack of
inspectors, insufficient routine inspections, and weak inter-agency coordination.
Furthermore, low awareness among MSMEs regarding food safety standards and
the absence of strict sanctions are the primary factors contributing to non
compliance with existing regulations. Thus, strengthening food safety policies is
necessary, including risk-based supervision, extensive education for business
actors, and the provision of incentives for MSMEs that comply with food safety
standards. This study's findings are expected to contribute to the development of
consumer protection policies in the food sector, particularly in establishing a more
effective and sustainable food safety system at the regional level.
