Abstract

The Chairman of BPOM issued a ban related to doctors reviewing skincare
products. This study aims to analyze the ban from the perspective of consumer
protection according to Law Number 8 of 1999 concerning Consumer Protection
and also to analyze whether the ban accommodates consumers' rights to obtain
accurate and transparent information about skincare products. The method used is
normative juridical research with a legislative approach and a conceptual
approach. The results of this study first show that this prohibition policy is not fully
aligned with the principles of consumer protection as stipulated in article 4 of Law
No. 8 of 1991 concerning Consumer Protection which guarantees consumers' rights
to true, clear, and honest information. When doctors are prohibited from providing
evidence-based education, the public loses one of the legitimate and neutral sources
of information, which should be part of the consumer protection system. Second,
the policy has implications for limited consumer access to credible and objective
information about the content and safety of skincare products, consumers are
exposed to more information from influencers or non-professionals who do not have
medical capacity, so the risk of misinformation increases. For this reason, it is
necessary to formulate more proportionate ethical guidelines and public education
mechanisms by medical personnel through official and neutral media. So that
consumer protection continues without sacrificing the integrity of the medical
profession
