PERLINDUNGAN KONSUMEN TERHADAP PRODUK KECANTIKAN KOSMETIK YANG TIDAK TERDAFTAR BPOM DALAM JUAL BELI ONLINE (E-COMMERCE)

This study aims to examine the form of legal protection for consumers and the liability of business actors for cosmetic products that are not registered with the Indonesian Food and Drug Authority (BPOM) and are sold through online trading systems (e-commerce). The research is based on the importance of the government's role in ensuring consumer rights as regulated in Law Number 8 of 1999 concerning Consumer Protection, particularly in relation to safety and comfort in the use of cosmetic products. The method used in this study is normative juridical, with a statutory approach and literature review. The results of the study indicate that products without distribution permits from BPOM are categorized as illegal products and may pose a risk to consumers. The form of legal protection provided includes the obligation of business actors to offer compensation, either through refunds, product replacement, or health services, as stipulated in Article 19 of the Consumer Protection Law and Article 1365 of the Indonesian Civil Code. If business actors fail to fulfill their obligations, consumers may seek dispute resolution through the Consumer Dispute Settlement Agency (BPSK) or through the court system.
