Abstract

The implementation of Ministerial Regulation of ATR/BPN No. 3 of 2023 regarding the issuance of electronic documents in land registration is being carried out gradually through a pilot project scheme. This transformation marks a significant leap for ATR/BPN, which previously only issued land certificates in physical form. This study aims to explore the implementation and challenges in adopting electronic land certificates at the ATR/BPN Office of Malang Regency. The research uses an empirical legal method, focusing on two main issues: (1) how the electronic certificate is being implemented in Malang, and (2) what obstacles are encountered in its issuance following the enforcement of the regulation. The process began in mid-2024 with land owned by ATR/BPN itself as the starting point. During the transition period, the public was given two options: initial land registration and conversion from conventional to electronic certificates. However, public understanding of the digital certificate system remains low, with most still preferring conventional certificates. As of now, the use of electronic certificates has not yet reached 10%. Internal challenges also exist, such as limited human resources and the need for training on the new system. Overall, this transformation still requires further adaptation to be fully accepted and effectively utilized by the people of Malang Regency.
