IMPLEMENTASI PASAL 95 UNDANG-UNDANG NOMOR 28 TAHUN 2014 DALAM PENYELESAIAN SENGKETA HAK CIPTA ARANSEMEN MUSIK DAN KOREOGRAFI PADA KEGIATAN MARCHING BAND DI KOTA MALANG

This study discusses the implementation of Article 95 of Law Number 28 of 2014 on Copyright in resolving copyright disputes over music arrangement and choreography in marching band activities in Malang City. This research is motivated by the frequent copyright violations in the form of unauthorized use of music arrangements and choreographies. The study employs an empirical approach with data collection techniques through interviews and literature studies. The results show that copyright disputes in the marching band community can be resolved through alternative dispute resolution mechanisms such as mediation, negotiation, and conciliation as regulated in Article 95. One implementation is reflected in the resolution of a dispute between two marching bands in Malang City, which was successfully settled through mediation resulting in a written agreement. The main obstacle in implementing this article is the low level of legal awareness and understanding among marching band practitioners regarding copyright protection mechanisms. Therefore, efforts in legal education and institutional strengthening are needed to enforce legal protection for music arrangements and choreography in marching band activities.
