PERTANGGUJAWABAN PERUSAHAAN EKSPEDISI ATAS RUSAK ATAU HILANGNYA BARANG MELALUI EKSPEDISI DARAT (STUDI DI PT. ASKAR BIMA TRANS)

This study examines the liability of shipping companies for damage or loss of goods in land shipping services, with a case study of PT. Askar Bima Trans. The background of this study stems from the increasing use of land shipping services in Indonesia, in line with the rapid growth of the national e-commerce and logistics industries. The study aims to analyze the form of liability of PT. Askar Bima Trans toward consumers and identify the challenges faced in fulfilling such liability. The research method employed is empirical legal research with a sociological-legal approach, examining applicable legal norms. Data was obtained through field studies in the form of interviews, observations, and documentation, as well as literature studies to support legal analysis. The results of the study show that PT. Askar Bima Trans applies the principle of liability based on proof of the main cause of damage or loss of goods, and limits liability through internal provisions that are often not explained in detail to consumers. This creates difficulties for consumers in the compensation claim process. However, based on Law No. 8 of 1999 on Consumer Protection and Article 1366 of the Civil Code, businesses have an obligation to provide compensation for losses arising from negligence or breach of contract. This study contributes to strengthening understanding of the principles of civil liability in transportation service relationships and serves as a basis for evaluating consumer protection policies in the freight forwarding sector.
