Abstract

This study aims to analyze the settlement of default disputes in the rental of outdoor and camping equipment at Arjuna Rental, Malang City. The research method used is empirical juridical with a case study approach through interviews, observations, and documentation of related parties. The results of the study indicate that the forms of default that often occur are late return of equipment, damage to goods, and loss of equipment, most of which are caused by the negligence of the tenant. Arjuna Rental resolves disputes in two ways: non litigation through negotiation and mediation, and litigation through legal channels if amicable settlement fails. In practice, amicable settlement is more effective and efficient, especially considering long-term relationships with customers. However, the lack of a detailed written agreement and weak evidence often become obstacles in the dispute resolution process. Therefore, it is recommended that Arjuna Rental create a clear written rental contract, including default clauses, tenant responsibilities, and dispute resolution mechanisms. In addition, education for tenants regarding rights and obligations needs to be improved to reduce the potential for disputes in the future
