Abstract

The unlicensed screening of film clips on social media provides losses to copyright holders either economically or morally. The purpose of this study is to find out how legal protection for copyright holders related to the airing of film clips on social media. The research method used in this study is the normative legal method. This research uses a legislative approach, and a conceptual approach regarding film copyright protection in intellectual property law. The results of the study show that legal protection efforts for copyright holders, both preventively and repressively, are basically good in Indonesia and the international realm. However, the legal protection is still not running optimally because there is a legal ambiguity that in preventive protection related to the benchmark or limitation of the use of the work commercially and the limitations on the use of duration and substantial content related to the violation of moral rights and economic rights have not been concretely regulated. With this, several efforts are needed to overcome this. These efforts are either new efforts in regulatory policies such as the application of the fair use doctrine explicitly regulated in copyright law in the United States or efforts for the public.
