Abstract
This study aims to analyze the fulfillment of labor wages based on Law Number 2 of 2022 concerning Job Creation, as well as the forms of legal protection for workers who receive wages below the standard. The research method used is a socio-legal approach, which examines the implementation of legal norms in the social reality of society, particularly in wage practices within the small and medium enterprise (SME) sector. The research findings indicate that wage fulfillment at remains below the Provincial Minimum Wage (UMP) of West Papua, amounting to IDR 1,500,000 compared to the 2024 UMP standard of IDR 3,393,000. Although the business owner provides additional compensation in the form of meals and housing, legally this practice does not meet the minimum wage provisions as stipulated in Article 88C of the Job Creation Law. On the other hand, a lack of understanding of the regulations and limited financial capacity of employers are the main obstacles in implementing wage policies. Legal protection for workers who receive wages below the standard includes the right to access dispute resolution mechanisms, protection from unilateral termination of employment, and administrative or criminal sanctions against violating employers. This study concludes that there is still a gap between legal provisions and practices in the field, thus requiring stricter labor supervision and legal education for both employers and workers to achieve comprehensive labor welfare.
